  1. COSTS AND TERMS
    1. Fees for the rendering of the services shall be agreed upon prior to the examination and communicated to the Client and will be attached as an annexure to this agreement in the form of a quotation.
    2. The Company requires a 50% (of the total accepted and signed quotation) non-refundable deposit when scheduling an examination(s).
    3. First-time clients are required to pay the full amount quoted before rendering of services and would then become eligible for partial payment upfront by means of a 50% deposit for future services.
    4. Any forfeiture or default on payment will result in the termination of contract agreement and T’s and C’s.
    5. The Client shall pay the fees by electronic transfer into a bank account nominated by the Company. Written confirmation of a booked test secures the client's timeslot.
    6. Once full payment has been made to the Company and upon the delivery of services, fees shall not be refunded.
    7. Should the Company not be able to render the service on the mutually agreed upon date and time for whatever reason outside the Company’s control, including but not limited to-
      1.  the unavailability of the examinee; and/or
      2. the refusal of the Examinee to sit for or cooperate with the examiner’s instructions the polygraph examination; and/or
      3. any reason related to the Health of the Examinee; and/or
      4. the unsuitability of the Examinee to sit for a polygraph examination, whether temporarily or permanently (the decision in this regard is at the sole discretion of the Company).
      5. any attempt to manipulate or interfere with the examination process, including countermeasures.
      6. the Client shall remain liable for full payment of the service the Company was unable to render: 
      7. The Client and the Company may then agree to reschedule the rendering of the service to another date and time suitable to all parties upon further payment.
    8. The rates set out in this agreement may increase on an annual basis without prior notice, to remain inline with market related factors such as inflation and economic related factors.
  2. METHOD OF PAYMENT
    1. Only EFT payments are accepted. Confirmation of Proof of Payment and written confirmation of a scheduled test andsecures the services to be rendered.
  3. BOOKINGS
    1. The client shall schedule an appointment with the Company in advance with due regard to the Company’s minimum requirements for the rendering of the services. 
    2. Minimum required scheduling timeframe of 3 (Three) business days are required unless othrwise agreed upon. This is at the sole discretion of the Company.
  4. CANCELLATIONS AND POSTPONMENTS
    1. Cancellations or rescheduling requests must be communicated to the Company at least 2 (Two) business days in advance.
  5. SERVICE AND SCOPE
    1. Veridicus Polygraph Services (Pty) Ltd offers a free remote telephonic or virtual consultation to provide you with the best solutions that are customized to your needs.
    2. The Company shall provide Forensic Interview and/or Polygraph Examinations services to the Client.
    3. The Client acknowledges that the results of the polygraph examinations are based on professional assessment and interpretation by the Company and are not guaranteed to be absolute or conclusive.
    4. While the Company strives for accuracy, the Client acknowledges that polygraph examinations may not provide definitive answers. The Company will make every effort to ensure the accuracy of its examinations but does not guarantee results.
    5. As per industry guidelines and accepted practices, no more than 5 tests will be conducted on the same day.
  6. REPORTS
    1. A full written report will be sent within 7 (Seven) days of the test being conducted, subject to full payment.
    2. Reports will only be sent in a “PDF” format via e-mail to the requestor of the test. No verbal results will be released by any examiner unless otherwise instructed to do so.
      1. No results will be communicated or shared directly with the examinee unless otherwise instructed to do so. 
  7. WARRANTIES
    1. The Company warrants that it:
      1. Is duly registered as a Polygraph Examiner with the relevant governing entities.
      2. Has the necessary experience, know-how, qualification, expertise and ability to provide the services.
      3. Will comply with all the applicable present and future laws, rules and regulations relating to the services and the provision of the Services as the Service Provider, including but not limited to the following:
        1. The Basic Conditions of Employment Act no 75 of 1997, as amended from time to time.
        2. The Labor Relations Act no 66 of 1995, as amended from time to time.
        3. The Protection of Personal Information Act no 4 of 2013, as amended from time to time.
  8. CLIENT OBLIGATIONS
    1. Before commencement of the polygraph examination, the following will be required from the Client:
      1. Payment Confirmation
      2. Date, venue, and time
      3. List of individuals to be tested.
      4. ID Numbers and Employee Numbers of all individuals
      5. Purpose and details of services requested.
      6. Relevant questions to be included in Polygraph test.
      7. Full case facts around the matter under investigation
  9. TEST LOCATION MINIMUM REQUIREMENTS
    1. The Client shall ensure that the examination area MUST adhere to the following;
      1. a well-ventilated and well-lit private room, free from disturbance;
      2. a medium sized sturdy desk or table;
      3. three sturdy chairs (no wheels and no swivel / tilt);
      4. stable electricity supply point (plug-point);
      5. water and soap.
  10. EXAMINEE MINIMUM REQUIREMENTS
    1. To enable the polygraph examiner to conduct an accurate polygraph examination it is required for each examinee to fully comprehend and understand the contents of the pre-test interview as explained by the examiner.
    2. Forensic Interviews and Polygraph examinations are normally conducted in the English language. Should the examinee not be able to understand the examiner due to a language barrier, the client will be liable to pay for the examination scheduled and the polygraph examiner will not be able to provide an opinion regarding the examinee’s honesty.
    3. If required, a sworn interpreter may be sub-contracted by Veridicus Polygraph Services (Pty) Ltd, at an additional cost to the client per day.
    4. Such a request, for a sworn interpreter, needs to be made known when the booking is made to ensure the availability of the interpreter.
  11. CONDUCT AND COOPERATION
    1. The Client is responsible for providing truthful and accurate information regarding the purpose of the polygraph examination and any relevant details. Falsification of information may result in the termination of this Services and/or validation of the polygraph examination.
    2. The client acknowledges that partaking in the polygraph examination is voluntary and that the examinee may not be coerced to do so.
    3. The Client acknowledges that the examinee has voluntarily consented to undergo a polygraph examination. The Company will obtain written consent from the examinee before conducting any examination, following all instructions, and refraining from any disruptive behaviour that may compromise the integrity of the examination.
    4. The client and/or examinee shall fully cooperate with the polygraph examiner during the testing process.
    5. Any attempt to manipulate or interfere with the examination process may result in termination of the examination.
    6. The Examiner reserves the right to terminate the examination at any point if the abovementioned guidelines are not met. Full payment will still be due should this be the outcome.
  12. GOVERNING LAW, DISPUTE RESOLUTION AND LIMITATION OF LIABILITY
    1. These TERMS AND CONDITIONS shall be governed by the laws of the Republic of South Africa.
    2. Any disputes arising from or in connection with these TERMS AND CONDITIONS shall be subject to mediation, and if unresolved, shall be resolved through arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
    3. The Client irrevocably indemnifies and holds harmless, the Company against all and any actions, suits, proceedings, claims, demands, costs and expenses of whatsoever nature and howsoever incurred which may be taken or made against the Company or be incurred or become payable by the Company arising from the use or reliance on the polygraph examination results, including but not limited to personal, financial, or reputational damages.
  13. AMENDMENT AND TERMINATION
    1. The Company reserves the right to amend these TERMS AND CONDITIONS at any time without prior notice.
    2. The Company may terminate its services to the Client if there is a breach of these TERMS AND CONDITIONS.
  14. CONFIDENTIALITY AND PRIVACY
    1. The Company shall treat all information acquired during the polygraph examination process as confidential and shall not disclose such information without the client and/or examinee consent, except as required by law.
